San Diego Amateur Hockey Club

MISSION STATEMENT

The purpose of SDAHC is to develop the skills, sportsmanship and leadership that are commensurate with the game, as well as to develop the highest possible caliber of player.

CORE VALUES

PHILOSOPHY OF YOUTH HOCKEY

The mission is to provide an improved grassroots foundation for the growth and development of USA Hockey, designing programs aimed at increasing participation, improving skills and offering a responsible environment for the conduct of youth hockey.  To achieve these ends, the SDAHC adopts the USA Hockey Model Program Guidelines which dictate:

v     A safe and healthy environment for all.

v     An opportunity for all new players who wish to play hockey.

v     Fair and equal opportunity for all to participate in our sport.

v     An opportunity to learn the basic skills without an over-emphasis on winning.

v     A philosophy which attempts to reduce the number who become disenchanted.

v     An opportunity for those who wish to advance in a more competitive environment.

v     Qualified adult leadership.

Hockey Categories:

v     A/B/BB or Recreational - the backbone of youth hockey, recreational hockey encourages developmental play. Skill development and team concepts are stressed, rather than winning.

v     AA or tier II - Well-qualified coaches teach higher-level skill development for players who have the desire and ability for a competitive experience. Balance of winning and sportsmanship is stressed, and travel for the competition should be reasonable. Team objectives include local, league, state and national championships.

v     AAA or Tier I - A high level national program which draws from the very best players in the state. This is primarily for players who seek to advance to Junior A or college hockey.


MEMBERSHIP

v     Term of Membership: Annual membership shall commence upon registration of the player and payment of the Club deposit, and shall conclude on April 30th of the following year.  Players may be registered only after the player and parent(s) or guardian(s) of the player sign and return a Letter of Intent and a Club Financial Agreement.

v     Eligibility: Eligible members include parents or guardians of rostered players who have paid the Club deposit and who reside within the State of California. 

v     Fees: The yearly membership fee shall be considered paid with a player’s deposit.  There is one and only one membership per paid deposit.

v     Responsibilities: All members and their families shall abide by the bylaws and the policies and procedures set forth herein. Members are responsible for participating in the association’s designated fund raising events applicable to their level, either via participation or cash buyout, and must keep current on all financial obligations. Members are also required to participate in the Club’s tournaments and events either by participation or cash buyout.  Members should report any known violation of the Code of Conduct or Sexual and Physical Abuse policy or other infractions in writing to the Board of Directors of SDAHC or to the Disputes and Resolutions Committee.

v     Privileges: Members each get one vote in the annual election of team representatives to the Board of Directors.  Each player is assigned one vote to be cast by a parent or guardian.  Members are encouraged to attend open board meetings. Members with issues or concerns should submit written documentation of the problem and recommended actions to the Board or to the Disputes and Resolutions Committee.

v     Removal: Members may be expelled for cause by the affirmative vote of two-thirds majority of the Board of Directors.

v     Annual Meetings: The annual meeting of SDAHC shall convene no later than June 30th and no earlier than the second Tuesday in May.

v     General Membership Meetings: A general membership meeting may be called if 50% plus 1 of current members sign a petition to meet. A general membership meeting may also be called by a two-thirds majority vote of the Board of Directors.  A general membership meeting may be called to recall Board members, change the Club bylaws or Club policies.  Financial matters cannot be discussed, debated or decided at general membership meetings.  Rules governing recall of Board members shall be prescribed by the Board.

v     Voting: Members must attend the Annual Meeting, Board meetings, committee meetings or any designated general membership meeting in person to exercise their vote.


BOARD OF DIRECTORS

v     SDAHC shall be governed by a Board of Directors. The Board shall have the power to interpret the various rules and regulations of SDAHC.   Board powers and responsibilities are listed in the Club’s bylaws.  The following list of responsibilities and requirements supplement the responsibilities and requirements imposed by the bylaws.

v     The property, business and affairs of SDAHC shall be managed by its Board of Directors and the Board may exercise all such power of SDAHC as are not by law, or by policies, directed or required to be exercised by the members.

v     The Board shall have the authority to appoint individuals to positions and to establish organized structure as necessary to provide successful programs.

v     Each Director must disclose any conflicts of interest prior to board action.

v     A quorum shall be a simple majority of the current seated board at each meeting. If a quorum is not achieved the business meeting will be canceled and no business will be conducted.   All meetings will be governed by Robert’s Rules of Order, except as otherwise stated in this manual.

v     No individual Board Member shall be liable for the debts or obligations of SDAHC, nor shall Board members be collectively liable for the debts or obligations of the Club.

v     Nominations for election to the Board of Directors must be presented to the Club President before the end of any open meeting or before the beginning of the Annual Meeting.

v     Proposed changes to the bylaws must be presented to the Board of Directors at least one month prior to the Annual Meeting.

v     Nominations to the Board and the proposed changes to the bylaws must be circulated to the membership of the Club for at least one week before approval.

v     It is the responsibility for Board members to attend all board meetings or provide a written report in lieu of attendance

v     Any vacancy occurring on the Board of Directors may be filled by appointment by the Board of Directors, upon nomination by the President. Each Board member so appointed to fill a vacancy shall hold the office until the next Annual Meeting.

v     Any member of the Board of Directors may resign at any time by giving written notice to the President or Secretary. Such resignation shall take effect at the time specified in the notification. This resignation does not need to be accepted by the Board of Directors to take effect.

v     No board member, other than the Director of Hockey, shall receive cash compensation for services rendered, but a board member may be reimbursed for expenses reasonably incurred on behalf of SDAHC if approved by the Board of Directors.

COMMITTEES:

Coaches Council

v     Shall be chaired by the Director of Hockey or in his absence the ACE Coordinator.  The Director of Hockey shall set meeting times and rules.

v     Shall oversee and administer day to day the hockey operations of the Club.

v     Shall make recommendations regarding hockey operations, including team selection, player movement, camps, clinics, tournaments, and so on to the board for approval.

v     Shall mediate and administer disciplinary actions to coaches and assistant coaches.

v     Shall review and nominate coaches and assistant coaches for board approval. Coaches shall be nominated by slate and shall be considered by the Board under an approval vote.

FINANCE COMMITTEE

v     To be composed of the Treasurer, Director of Managers, Director of Fundraising and one team representative appointed by the President.  The Finance Committee shall review the SDAHC annual fee structure.

v     Shall evaluate fund raising opportunities.

v     Shall establish the financial course of the association by setting the annual Club budgetary reserve necessary for prudent financial management and setting a targeted level for Club sponsorships and scholarships for the coming season.

v     Shall conduct an annual review of the Club’s account and all team accounts and prepare a report of this review for the Annual Meeting.

Disputes and Resolutions committee (dnr)

v     Shall be appointed by the President.

v     Shall consist of two members of the Board of Directors and three at large members of the Club.

v     Shall be chaired by a member of the Board of Directors, who shall call the Committee’s meetings and shall manage the Committee’s business.

v     Shall decide disputes involving Club members and the Disciplinary Committee and between the Board of Directors and Club members. 

v     Decisions of the DNR shall be final, except that the DNR can not, under any circumstances, obligate the Club to make payment to any person or entity, without Board approval.  DNR requests for payment from the Club’s accounts will be made to the Board by the chair of the DNR and will be subject to a disapproval vote, wherein, the DNR’s recommendation for payment is accepted unless two-thirds of the Board members present and voting object in a recorded vote.  On all other matters, the chair of the DNR will report its decisions to the Board at its next monthly meeting.

GRIEVANCES

v     Must be submitted in written format within 3 days of incident.

v     The chain of command must be observed:

v     Parent must send grievances to Disputes and Resolutions Committee who in turn reports to the Vice President who in turn reports to the Board

v     Coaches submit grievances to the Director of Hockey and the Coaches Council who in turn reports to the Board

v     Players submit grievances to their Coach, and failing a satisfactory outcome submit their grievances to the Director of Hockey who in turn reports to the Coaches Council and the Board.

v     There will be an investigation period beginning within seven days of the incident, not including weekends and holidays.

v     A hearing will be held in a timely manner.

v     The final arbiter of all grievances is the Disputes and Resolutions Committee, whose verdict will determine the outcome.

COMMUNICATIONS COMMITTEE

v     Shall be chaired by the Director of Publications.

v     Shall have members responsible for publishing and distributing the Club’s monthly newsletter.

v     Shall have members responsible for updating and maintaining the website.

v     Shall establish contacts to news organizations, television and radio so as to be able to facilitate news releases from SDAHC.

Registration Committee

v     Shall be chaired by the Club Registrar.  The Club registrar shall determine the time, place and manner of meetings. 

v     Shall assist the Club registrar in the fulfillment of his/her duties.

RULES, REGULATIONS, Conduct and Discipline

SDAHC is an association sanctioned by USA Hockey through the California Amateur Hockey Association (CAHA).  The philosophies of competition change with each increasing level and need to be explained to the players and parents at the first team meeting. SDAHC shall be governed by league rules established by the Southern California Amateur Hockey Association (SCAHA), CAHA and USA Hockey. The Club also participates in the Southwest Youth Hockey League and is governed by their rules and regulations as well.  These rules are published and a copy may be provided through our area representative or via their web sites:

ZERO TOLERANCE POLICY

In an effort to make ice hockey a more desirable and rewarding experience for all participants, the USA Hockey Youth, and Senior Councils have instructed the Officiating Program to adhere to certain points of emphasis relating to sportsmanship. This campaign is designed to require all players, coaches, officials, team officials and administrators and parents/spectators to maintain a sportsmanlike and educational atmosphere before, during and after all USA Hockey -sanctioned games.

 

The following points of emphasis must be implemented by an On-Ice Referee and Linesman.

PLAYERS: A minor penalty for unsportsmanlike conduct (Zero Tolerance) shall be assessed whenever a player:

Ø     Openly disputes or argues any decision by an official.

Ø     Uses obscene or vulgar language at any time, including any swearing, even if it is not directed at any particular person.

Ø     Visually demonstrates any sign of dissatisfaction with an official’s decision. Any time that a player persists in any of these actions, they shall be assessed a misconduct penalty. A game misconduct shall result if the player continues such action.

COACHES: A minor penalty for unsportsmanlike conduct (Zero Tolerance) shall be assessed whenever a coach:

Ø     Openly disputes or argues any decision by an official.

Ø     Uses obscene or vulgar language in a boisterous manner to anyone at anytime.

Ø     Visually displays any sign of dissatisfaction with an official’s decision including standing in the bench doorway with intent of inciting the officials, players or spectators.

Ø     Any time that a coach persists in any of these actions, they shall be assessed a game misconduct penalty.

PARENTS AND SPECTATORS:

Ø     The game will be stopped by on-ice officials when the parents/spectators displaying inappropriate and disruptive behavior interfere with the other spectators or the game. The on-ice officials will identify violators to the coaches for the purpose of removing parents/spectators from the spectator’s viewing and game area. Once removed, the play will resume. Lost time will not be replaced and violators may be subject to further disciplinary action by the local governing body. This inappropriate and disruptive behavior shall include:

Ø     Use of obscene or vulgar language in a boisterous manner to anyone at any time.

Ø     Taunting of players, coaches, officials or other spectators by means of baiting, ridiculing, threat of physical violence or physical violence.

Ø     Throwing of any object in the spectators viewing area, player’s bench, penalty box or on ice surface, directed in any manner as to create a safety hazard.

ABUSE POLICY

SDAHC adheres to all USA Hockey policies regarding sexual, physical or drug and alcohol abuse.  Go to www.usahockey.com for a complete description of these policies.  In sum,

Sexual Abuse

SDAHC has adopted the USA Hockey Screening policy.

Physical Abuse

Ø     It is the policy of USA Hockey that there shall be no physical abuse of any participant involved in any of its sanctioned programs, its Training Camps, Hockey Clinics, Coaches Clinics, Referee Clinics, Regional and National Tournaments or other SDAHC Hockey events by an employee, volunteer, or independent contractor.

Ø     Physical abuse means physical contact with a participant that intentionally causes the participant to sustain bodily harm or personal injury. Physical abuse also includes physical contact with a participant that intentionally creates a threat of immediate bodily harm or personal injury.

Ø     Physical abuse does not include physical contact that is reasonably designed to coach, teach or demonstrate a hockey skill. Permitted physical conduct may include, but is not necessarily limited to, shooting pucks at a goaltender, demonstrating checking and other hockey skills, and communication with or directing participants during the course of a game or practice, by touching them in a non-threatening, non-sexual manner.

CODE OF CONDUCT

The following policies of the USA Hockey have been embraced by SDAHC and will be strictly enforced by the coaching staff and administrators of the association. Any violations of the below policies will be dealt with by the Board.

 

Players, parents, coaches and spectators are required to maintain a sportsmanlike atmosphere before, during and after all SDAHC events, and to adhere to USA Hockey's Zero Tolerance Policy (see www.usahockey.com), summarized as follows:

 

The following actions are specifically prohibited:

1) verbal or physical abuse of a player, coach, official, parent or spectator on the ice, in the locker room, or in common areas
2) objectionable or offensive behavior, including obscene or vulgar language or gestures
3) no one should taunt players, coaches, officials or other spectators by means of baiting, ridiculing, threat of physical violence or physical violence
4) making sounds which can be mistaken for those of the game officials
5) damaging property: violators will be held accountable for damages and consequences as dictated by local authorities, and will be referred to the SDAHC Disciplinary Committee

Further,

- Only authorized coaches are allowed to enter the bench area.
- On-ice officials have the authority to suspend game play, remove disruptive participants, and assess penalties when inappropriate behavior occurs.
- League parents are not allowed in the locker room except when permitted by the coach.
* - SDAHC reserves the right to suspend a player, if necessary, for repeated or dangerous misconduct by the players’ parent.

Coaches, Players, Parents and Spectators are also governed by the following codes of conduct:

Coaches:

·        All coaches should read and be familiar with the USA Hockey Coaching Code of Ethics booklet.

·        Winning is a consideration, but not the only one, nor the most important one. Care more about the child than winning the game. Players are involved in hockey for fun and enjoyment.

·        Adjust to personal need and problems of the players: be a good listener; never verbally or physically abuse a player or official; give all players the opportunity to improve their skills, gain confidence and develop self-esteem, teach them the basics.

·        All coaches will follow guidelines set forth by the Club and Director of Hockey.

·        Be generous with your praise when it is deserved; be consistent and honest; be fair and just; do not criticize players
publicly; learn to be a more effective communicator and coach.

·        Be a good listener; never verbally or physically abuse a player or official; give all players the opportunity to improve their skills, gain confidence and develop self-esteem; teach them the basics.

·        Organize practices that are fun and challenging for your players. Familiarize yourself with the rules, techniques and
strategies of hockey; encourage all your players to be team players.

·        Maintain an open line of communication with your players’ parents.

Be concerned with the overall development of your players.

Be a team player -- get along with your teammates. Learn teamwork, sportsmanship and discipline.

Be on time for practices and games. Learn the rules and play by them. Always be a good sport.

Respect your coach, your teammates, your parents, opponents, and officials.

Never argue with an official’s decision.
Spectators Code Of Conduct

Display good sportsmanship. Always respect players, coaches and officials.

Act appropriately; do not taunt or disturb other fans; enjoy the game together.

Cheer good plays of all participants; avoid booing opponents.

Cheer in a positive manner and encourage fair play; profanity and objectionable cheers or gestures are offensive.

Help provide a safe and fun environment; throwing any items on the ice surface can cause injury to players and officials.

Do not lean over or pound on the glass; the glass surrounding the ice surface is part of the playing area.

Support the referees and coaches by trusting their judgment and integrity.

Be responsible for your own safety -- be alert to prevent accidents from flying pucks and other avoidable situations.

Respect locker rooms as private areas for players, coaches and officials.

Be supportive after the game -- win or lose. Recognize good effort teamwork and sportsmanship

 

DISCIPLINARY RULES & PROCEDURES

SDAHC is a self-governing organization and will attempt to internally resolve all concerns and disputes among its members, parents, players, coaches and officials. To facilitate the efficient resolution of issues and disputes, these procedures must be followed:

1) Coaching Matters -- All matters involving coaches, the conduct of coaches at games or practices, issues regarding the usage of players or ice time, must first be referred to the Director of Hockey for consideration and possible action.

2) Non-Coaching Matters -- All other matters involving the conduct of members, players, parents, or officials of SDAHC must be referred to both the Director of Hockey and the Vice President. Such matters will be brought to the SDAHC Disciplinary Committee for consideration and possible action.

3) If the Director of Hockey, or the Team Manager, is party to a disciplinary action, the matter must be referred to both the Vice President and the Board of Directors.   If the Vice President is party to a disciplinary action, then the matter is to be referred to the President and the Board of Directors.

4) If, after referring a Coaching or Non-Coaching matter to the proper authority as set forth above, the member, parent, player, coach or official still feels the matter has not been resolved, they may make a written appeal to the Disputes and Resolutions Committee (DNR) for SDAHC.  The decision of the DNR will be final.

5) Any further arbitration the parties feel is necessary is available through CAHA or USA Hockey pursuant to USA Hockey By-Laws, Article F.

Team Managers ARE REQUIRED to contact and report any instances to the Vice President or Director Of Hockey under the following circumstances:

1) When a player, parent or coach has been ejected from a game;

2) When a player, parent or coach violates the rules of conduct;

3) Where significant discipline has been imposed on a player by the team's coach;

4) When discipline previously assessed against a player by the team's coach has not caused that player's conduct to improve;

5) Whenever the Team Manager deems a referral appropriate.

SDAHC DISCIPLINARY COMMITTEE

SDAHC’s Disciplinary Committee is appointed by the President and approved by the Board, and remains intact throughout the season. This committee is chaired by the Vice President. During its meetings, the committee hears the argument at hand. Prior to the meeting, the Vice President inquire about the incident, and to invite any witnesses (other than the accused) to enlighten the committee. If the accused pleads "no contest", he must still appear before the committee.

The SDAHC Board of Directors and/or the Disciplinary Committee is authorized to investigate and assess discipline whether or not a matter has been brought directly to the Board of Directors attention by means of a formal complaint or report.

A majority vote of the Disciplinary Committee is required to dictate one of four actions:

1) Dismissal of the issue

2) Probation (this is not an option if the individual is before the committee for the second offense of the same nature)

3) Suspension and length of suspension, commensurate with infraction

4) Recommended expulsion by the Board of Directors (only in extreme cases, multiple disciplinary actions, or non-payment.)


Whenever possible and appropriate, discipline will be progressive, however SDAHC may assess any level of discipline deemed appropriate in a particular situation. A recommendation for expulsion requires a review of the incident by the Board of Directors. A two-thirds vote of a quorum of the Directors present of a monthly meeting of the Board of Directors will be required to expel a member.

After the Disciplinary Committee reaches a decision, a letter entitled "notice of disciplinary action" is issued from the Board Of Directors to the last known address of the individual being disciplined, informing him of the decision reached. Ordinarily, the decision of the

Disciplinary Committee is effective immediately, even if an appeal is subsequently filed. (Expulsion requires a hearing of the Board and therefore, cannot be immediate. See above.)

APPEAL PROCESS

Appeal of Disciplinary Committee-imposed discipline is not automatic. Those wishing to appeal discipline imposed against them must file a written Request for Appeal with the Director of Hockey or the Vice President within five (5) days of the date of the notice of disciplinary action letter, requesting a meeting before the SDAHC DNR. 

The DNR will meet with the appellant within ten (10) days of the receipt of the request for appeal, provided that this time limit can be extended by the DNR at its discretion. This meeting will be informal, and the board may receive whatever information it deems helpful or relevant.

Thereafter, the DNR will make its final decision. Discipline held in abeyance pending appeal will take effect immediately upon the issuance of a DNR decision in favor of discipline. At the time of its final decision, the DNR may revise or modify discipline previously recommended or assessed by the Director of Hockey or the Disciplinary Committee.

 The Disciplinary Committee has the right to suspend any player, parent or coach from attending SDAHC function for violations of SDAHC  Bylaws, rules and regulations, or policy. All coaches, team managers and parents are strongly urged to address problems or complaints as soon as possible.


Player Selection Process:

Player Evaluation Committee

v     A player Evaluation Committee will be used to evaluate all the players from the Mite through Midget levels.  There may be a different Player Evaluation Committee for each age group. Evaluation Committees will be assigned by the Director of Hockey. 

v     In addition to the individuals stated above, the Director of Hockey will have a vote, as will all of the coaches for that age division.  Final selections for a team require the approval of the Director of Hockey.

Player Evaluation and Tryout Sessions:

v     Players are assigned a number.  Players will be referred to by their number throughout their evaluation.  The evaluation committee is not given the player's name, they only know the players based on their numbers.

v     The parents/players will be asked which teams they would like to be considered for.  Consideration will be given to those players who wish to be assigned to the lowest skilled team despite their superior skill level to the extent possible such that team numbers are not skewed and overall team skill levels are not compromised inappropriately.  

v     A standardized evaluation sheet listing different skills will be given to the evaluation committee members.  Each committee member will assign a grade for each skill for each player.

v     The number of players per team will correspond to participation rate at that age level and all teams at a given age level should have a similar number of players per team.

v     The Vice President and/or Director of Hockey shall be present at the first session to explain the process to the parents and players.

v     There may be a skill and drill evaluation as well as an evaluation on scrimmages.

v     The player's coach will contact each player following the last session.

v     Placement of players who missed the evaluations may be restricted based on the numbers already on the teams at a given age level.  The skill level of the player shall be assessed by the evaluation committee or by a committee of coaches and an effort will be made to place the player on the appropriate team.

v     Any Tier I Team within the club may recruit and evaluate players at any time between the beginning of CAHA tryouts and December 31st.

REGISTRATION

Registration for the fall season will be held with a month after tryouts. 

The registration packet will contain a registration form, proof of insurance form, medical treatment consent form and waiver of liability form and any other forms required by USA Hockey, SCAHA, CAHA, the SWYHL or by SDAHC. A deposit, in the amount specified by the Board in the annual budget estimate, will be required for each player at registration. A player is not considered registered, and cannot be rostered on a team, until the deposit is received.

SDAHC will make every effort to accommodate players entering the program after the registration period has ended and/or after the season has started and team selections have been made. The size of teams, the number of available coaches and the availability of ice time may limit the number of players we can accommodate. 

RELEASES

v     The following govern permanent releases from SDAHC.

o       Players seeking a release from SDAHC must provide a statement in writing, naming the player, the player’s date of birth, and current or most recent team assignment of the player to the Board of Directors a minimum of 10 days prior to the next Board meeting.

o       The Board of Directors can grant a release based upon a simple majority vote. The Board is not obligated to hold a special session to vote on any release.

o       All fees must be paid in full before any release, permanent or temporary, can be granted.  The full amount of the Club’s annual fees, as well as any special assessments must be paid, and team fees, pro-rated up to the time of the release, must be paid, before a release will be granted.

o       Players requesting releases relinquish their team position. There are no guarantees that a player may return to his/her team if they change their mind about the release after it has been voted upon.

o       Once a release has been granted for a skating year, all membership rights shall be terminated until the next membership season.

o       If a team is disbanded by the Board of Directors, then releases will be granted as soon as all fees, including any and all Club and team fees, are paid in full.  This determination shall be made by the Club Treasurer and reported to the Board of Directors during the annual review of accounts.

v     Temporary releases may be granted, upon written permission, by a player’s coach, the Director of Coaches or Club President and one other Board member.

Suspensions (Financial)

v     Club fees are due on the 15th of the month.  Club dues are late on the 22nd of the month.  Any late payments are subject to suspension and penalty.  By the 20th of each month the Club Treasurer will inform each coach and team manager, via email, the list of their players who are currently pending suspension.  If payment is not received the Club Treasurer by the 22nd of the month, then the Treasurer will automatically suspend each player who is not current in their Club payments until such time as payments are received or a payment plan is approved by the Treasurer.  Starting April 1, 2004, a late fee of $50 will be added to all late payments for Club dues.  This is required and cannot be negotiated. 

v     The Club Treasurer will send the coaches and managers of each team a list of all suspended players by the 22nd of each month, via email.  Practicing or playing a suspended player can lead to the removal of the team manager, and to the suspension and/or removal of the coach, without pay, from the Club.  Email is considered sufficient communication.  No warnings to the coach or team manager are required for suspension.

v     Players can also be suspended by the team or Club for nonpayment of team fees.  The player’s parent or guardian must be informed via email, with copies sent to the coach and Club Treasurer that a player is delinquent in the payment of his/her team fees.  The player will be given one week to make payment plus a $25 late fee.  After one week, the team manager will ask the Club Treasurer, via email, with copies to the coach, to suspend the player.  The Club Treasurer will then suspend the player, notifying the player’s parents or guardian, via email, about the suspension and the steps necessary for reinstatement.  The player may not practice or play during a suspension.

v     The third time a player is suspended for late payment of team fees, and each time thereafter, the Club Treasurer may suspend the player for up to a month after reinstatement.

v     The Club Treasurer will inform the team manager, player’s parents, and coach when the player has been reinstated.

v     With regard to the collection of both Club and team dues, the manager and coach are deemed to be fiduciary agents of the Club, working to ensure the financial health of the Club and its teams.

v     At the end of the season, all delinquent members, who owe either Club or Team fees, penalties or fines, must be reported as delinquent to SCAHA and CAHA. 

Player Movement:

v     Each player will be required to skate at the level designated for their age. However if a coach from the next highest age level feels a player is capable of competing at the higher age level and with the approval of the Director of Hockey, that player will be identified and may practice with that higher age level and play with the higher level team. There will be a refundable $100 assessment for the year for each player who follows this move-up policy.  If the player is allowed to move up the $100 assessment will be refunded.

v     Once team rosters have been posted, coaches reserve the right to move (or cut) players until November 30. Movement (or cuts) after November 30 requires the prior approval of the Director of Hockey, or, in his/her absence, the Chair of the Coaches Council.  Players shall not be cut or move players after December 31st, except for disciplinary reasons, with the approval of the Director of Hockey and Vice President.

v     The Hockey Director shall set policies regulating player movement and has final approval over player movement.


Coach Selection Policy:

v     The Director of Hockey will be selected prior to the beginning of the season. 

v     The coach selection process will begin at the end of the season for the following season with a call for independent contractors and volunteers and an application form being completed by those who are interested. The Director of Hockey will conduct initial coach application evaluations, interviews, and advise applicants on the player selection process. The Director of Hockey will select coaches and, prior to the beginning of the season, recommend a slate of coaches to the Board of Directors for an approval vote.

v     Coaches must meet USA Hockey guidelines.

v     Coaches must attend coaches meetings as required.

v     SDAHC has adopted the USA Hockey methods of effective coaching as a model for its coaching staff.  The role of the coach is to be a leader, teacher and organizer.

v     The Director of Hockey will select assistant coaches after the teams are determined.

v     The Association will provide USA Hockey insurance coverage for all elected and appointed Board members and the coach, up to two assistant coaches and the team representative for each authorized team within the Association.  The Association will reimburse the USA Hockey coaching certification fee for the coach and up to two assistant coaches for each authorized team.  Reimbursement will occur upon submission of the Clinic Registration Form and a copy of the Coaching Education Program card.  Any exception to the above policy must be approved in advance by the Board with approval being noted in the minutes of that Board meeting.  A written request for an exception must be submitted to the Board in advance of the scheduled class and/or payment date.

Independent Contractor's Agreement

This Independent Contractor's Agreement (Agreement) is entered into this ____ day of ______________, 200_, by and between San Diego Amateur Hockey Club (Club), a non-profit California Organization, and _______________________________, an independent contractor (Coach), in consideration of the mutual promises made herein, as follows:

 

Term of Agreement.

This Agreement will become effective on the 1st day of ________________, and will continue in effect until __________________.

Services to be Performed by Coach.

Specific Services. Coach agrees to: train the ____________________ (Team) for the Club in its practices, and coach the team in its games, tournaments, and playoffs, as scheduled by the Board of Directors, the Club's Ice Convener, or the Team.  This includes, but is not limited to, SCAHA games, CAHA playoffs, Pacific District playoffs, and USA Hockey playoffs, and if necessary, SWYHL games and playoffs, as required by the Club, and any holiday or special tournaments as deemed in the team's interest by the Team or the Club.

Employment of Assistants. Coach may employ such assistants as Coach deems necessary, and at the Coach's expense, to perform the services required of Coach by this Agreement, abiding by any USA Hockey, league and Club rules and regulations.

Compensation.

Flat Fee. In consideration for the services to be performed by Coach, Club agrees to pay Coach the sum of ________________________ dollars, divisible into 8 monthly payments beginning in _____________ and ending in ____________.  Payments will be made in a manner as specified by Club rules, but will be no later than the 20th of each month they are due.

Duties of Coach.

Minimum Amount of Service. Barring illness, injury, or other necessary matters of an urgent nature, Coach agrees to train the Team at all of its practices and to coach the Team at all of its games, tournaments, and playoffs.

Hours During Which Services May be Performed. Coach agrees to perform the above-described services at the times specified for the Team's practices, games, tournaments and playoffs.

Suspensions:  The Coach may be suspended with or without pay and with or without a hearing for violating Club policy.  The coach will be notified by certified mail or the equivalent or any suspensions.  The Coach is entitled to a hearing before a closed session of the Executive Committee of the Club within two weeks of his or her suspension.  At the hearing the Coach may ask for reinstatement, including back pay.  

Tools and Instrumentalities. Coach will supply all tools and instrumentalities required to perform the services under this Agreement.

Liability. Coach further agrees to hold Club free and harmless from any and all claims arising from any such negligent act or omission.

Assignment. Neither this Agreement nor any duties or obligations under this Agreement may be assigned by Coach without the prior written consent of Club.

Termination Of Agreement.

Termination Upon Notice. Notwithstanding any other provisions of this Agreement, either party hereto may terminate this Agreement at any time by giving 7 days written notice to the other party.  There will be a termination fee paid by the terminating party to the other party in this contract equal to one-half of one month’s payments under this agreement.

 

General Provisions

Entire Agreement. This Agreement supersedes any and all agreements, either oral or in writing, between the parties hereto with respect to the rendering of services by Coach for Club, and contains all of the covenants and agreements between the parties with respect to the rendering of such services in any manner whatsoever. Each party to this Agreement acknowledges that no representations, inducements, promises, or agreements, orally or otherwise, have been made by any party, or anyone acting on behalf of any party, which are not embodied herein, and that no other agreement, statement, or promise not contained in this Agreement shall be valid or binding. Any modification of this Agreement will be effective only if it is in writing signed by both parties.

Severability. If any provision of this Agreement is held by a court of competent jurisdiction to be invalid, void, or unenforceable, the remaining provisions shall nevertheless continue in full force without being impaired or invalidated in any way.

Arbitration. Any controversy between the parties hereto involving the construction or application of any of the terms, covenants, or conditions of this Agreement will, on the written request of one party served on the other, be submitted to arbitration.

Governing Law. This Agreement shall be governed by and construed in accordance with the laws of the State of California.

v     Each of the blank spaces in the contract will be filled in, as necessary, by the Board of Directors at their annual meeting, or baring that, by the Secretary at a meeting of the Executive Committee. 

v     In the event that a contract is not completed or in the event that it is lost, Board approval of a coach’s contract, as written in the Club’s minutes, will imply the Club President’s signature, if such signature is lacking on a specific contract.  The cashing of a payment (on a check written on the Club’s account) under this contract by a coach will constitute acceptance of this contract by the coach. 

v     The Club’s Hockey Director and ACE Coordinator will be covered by the same model contract.


Miscellaneous Policies

Team Selection Policy

v     The Director of Hockey, after conferring with the Coaches Council, shall make recommendations to the Board of Directors for the number, level, and expected number of players for teams in the Club for the coming season.  This will form the basis of the annual budget.  During tryouts the Director of Hockey may make changes to the number, level and expected number of players for teams within the Club for the coming season, taking account required changes to the Club’s budget, ice rentals and as restricted by SCAHA, CAHA and USA Hockey rules and regulations.

FINANCIAL POLICY

v     The association fiscal year shall commence July 1 and end June 30.

v     There shall be two signatures on file with the bank for the SDAHC Checking and Savings accounts and for any SDAHC team account. For the Club account, those signatures shall be the Treasurer and one other Board members chosen by the Board at the first meeting following the Annual Meeting. For the team account, those signatures shall be the Treasurer and the team manager.

v     A finance committee shall be appointed with oversight of the association’s financial matters. They shall provide input on the annual budget, registration fee structure, fund raising goals and the financial matters of the association.

v     There shall be a monthly financial report at every board meeting.

v     A budget for the year shall be adopted at the annual meeting.

v     Club or team expenditures over $400 not expressly covered in the budget must be approved by the board.  In other words, no checks can be written from the Club account or from any team account for an amount exceeding $400 without prior written approval of the Club Treasurer.  Furthermore, no checks may be written to a member of the Club, one of its coaches or assistant coaches, or to any Board member without prior approval of the Club’s Treasurer.  Payments to the Club Treasurer in excess of $400 must be pre-approved in writing by the Club President.

v     The fee structure will be set by the Treasurer and the Finance Committee during the spring. The membership will be notified of the season’s current estimated fees prior to tryouts.

v     Estimated fees may change during the season.  The Board will strive to keep costs down and to maintain a stable fee structure.  Emergency circumstances, however, may require the Board to change its dues, assess special fees, or to cut back on expenses, by requiring teams to share practices or to cancel exhibition games.  Notice will be given to any team whose budget is to be altered during the season.

Sponsorships:

v     Only the Club issues sponsorships or scholarships, by majority vote of the Board of Directors.  Scholarships are need based and are given only after application by a players and/or his or her parent or guardian.  The Club has defined procedures for determining need.  Sponsorships are team based.  Sponsorships are given only upon application by a coach.  No player may receive a sponsorship or scholarship greater than 75% of the Club dues for a season.  All sponsored or scholarship players must pay at least one-half (1/2) of the Club deposit when it is due.  Players may be sponsored for team fees, or travel expenses, upon notification to and approval by the Board. 

v     All sponsorship and scholarship players and their parents shall receive a letter from the Club indicating the amount and terms of their sponsorship and scholarship.  Sponsorships and scholarships will not be recognized without a letter stating the amount and duration of the sponsorship or scholarship, signed by the President or Treasurer.  No verbal commitments are binding on the Club.

v     All sponsorships are revocable, without cause.  The Club, through its Board of Directors at its annual meeting, will establish scholarship and sponsorship levels for the coming season.  Coaches and team managers do not speak for the Club regarding scholarships and sponsorships.  No managers or coach’s promise or statement can obligate the Club to provide a sponsorship or scholarship. 

v     Sponsorships are available to defray the cost of team fees and player travel as well.  These too can be given only by the Club upon approval of the Board of Directors after application by a coach.  Sponsorships for team fees and travel may not exceed one-half (1/2) of the Club’s fees in any one season.

v     The Club never covers or sponsors billeting expenses.  Billet families must deal directly with a billeted player’s family.

COMMUNICATIONS POLICY

v     Minutes of the board meeting will be completed and mailed to each board member by post or electronic mail within 1 week.

v     Minutes of closed executive sessions will not be posted or published in a public format.

v     There will be an association newsletter. The newsletter will be mailed or posted on internet as soon as possible after the monthly board meeting.

v     Association names and addresses will not be sold.

v     No association member names will be distributed without board approval.

v     Pictures of teams may be submitted to press for publicity reasons.

v     Copies of all communication must be provided to the Secretary.

v     Policy changes maybe made at any board meeting where a majority vote to change the policy. The policy manual will be updated annually. Policy changes will be made public and posted with the minutes of the monthly Board meetings. 

FUND RAISING

v     SDAHC is classified as a non-profit organization, and donations to our organization are tax deductible. All teams and participants have a responsibility to project a positive image of the team and SDAHC. At all times the public image of SDAHC membership conduct and appearance must be above reproach and in good taste. All fund raising programs must include a budget and be approved by the Finance committee. All programs must be well supervised and controlled.

v     Work credits for the above three fundraisers may not be carried over from one year to the next. Hours worked after the annual meeting are credited to the upcoming season.

v     Individual Team Fund Raising Projects - Teams may conduct minor fundraisers to raise money for needs specific to their team during the season. Unspent profits must be refunded to the team or donated to the organization by May 1st following the season. After May 1st, all funds raised by SDAHC members are the sole property of the SDAHC general fund.

 

DISCIPLINARY RULES & PROCEDURES

SDAHC is a self-governing organization and will attempt to internally resolve all concerns and disputes among its members, parents, players, coaches and officials. To facilitate the efficient resolution of issues and disputes, these procedures must be followed:

1) Coaching Matters -- All matters involving coaches, the conduct of coaches at games or practices, issues regarding the usage of players or ice time, must first be referred to the Director of Hockey for consideration and possible action.

2) Non-Coaching Matters -- All other matters involving the conduct of members, players, parents, or officials of SDAHC must be referred to both the Director of Hockey and the Vice President. Such matters will be brought to the SDAHC Disciplinary Committee for consideration and possible action.

3) If the Director of Hockey, or the Team Manager, is party to a disciplinary action, the matter must be referred to both the Vice President and the Board of Directors.   If the Vice President is party to a disciplinary action, then the matter is to be referred to the President and the Board of Directors.

4) If, after referring a Coaching or Non-Coaching matter to the proper authority as set forth above, the member, parent, player, coach or official still feels the matter has not been resolved, they may make a written appeal to the Disputes and Resolutions Committee (DNR) for SDAHC.  The decision of the DNR will be final.

5) Any further arbitration the parties feel is necessary is available through CAHA or USA Hockey pursuant to USA Hockey By-Laws, Article F.

Team Managers ARE REQUIRED to contact and report any instances to the Vice President or Director Of Hockey under the following circumstances:

1) When a player, parent or coach has been ejected from a game on more than one occasion;

2) When a player, parent or coach violates the rules of conduct;

3) Where significant discipline has been imposed on a player by the team's coach;

4) When discipline previously assessed against a player by the team's coach has not caused that player's conduct to improve;

5) Whenever the Team Manager deems a referral appropriate.


SDAHC DISCIPLINARY COMMITTEE

SDAHC’s Disciplinary Committee is appointed by the President and approved by the Board, and remains intact throughout the season. This committee is chaired by the Vice President. During its meetings, the committee hears the argument at hand. Prior to the meeting, the Vice President inquire about the incident, and to invite any witnesses (other than the accused) to enlighten the committee. If the accused pleads "no contest", he must still appear before the committee.

The SDAHC Board of Directors and/or the Disciplinary Committee are authorized to investigate and assess discipline whether or not a matter has been brought directly to the Board of Directors attention by means of a formal complaint or report.

A majority vote of the Disciplinary Committee is required to dictate one of four actions:

1) Dismissal of the issue

2) Probation (this is not an option if the individual is before the committee for the second offense of the same nature)

3) Suspension and length of suspension, commensurate with infraction

4) Recommended expulsion by the Board of Directors (only in extreme cases, multiple disciplinary actions, or non-payment.)


Whenever possible and appropriate, discipline will be progressive, however SDAHC may assess any level of discipline deemed appropriate in a particular situation. A recommendation for expulsion requires a review of the incident by the Board of Directors. A two-thirds vote of a quorum of the Directors present of a monthly meeting of the  Board of Directors will be required to expel a member.

After the Disciplinary Committee reaches a decision, a letter entitled "notice of disciplinary action" is issued from the Board Of Directors to the last known address of the individual being disciplined, informing him of the decision reached. Ordinarily, the decision of the

Disciplinary Committee is effective immediately, even if an appeal is subsequently filed. (Expulsion requires a hearing of the Board and therefore, cannot be immediate. See above.)

APPEAL PROCESS

Appeal of Disciplinary Committee-imposed discipline is not automatic. Those wishing to appeal discipline imposed against them must file a written Request for Appeal with the Director of Hockey or the Vice President within five (5) days of the date of the notice of disciplinary action letter, requesting a meeting before the SDAHC DNR. 

The DNR will meet with the appellant within ten (10) days of the receipt of the request for appeal, provided that this time limit can be extended by the DNR at its discretion. This meeting will be informal, and the board may receive whatever information it deems helpful or relevant.

Thereafter, the DNR will make its final decision. Discipline held in abeyance pending appeal will take effect immediately upon the issuance of a DNR decision in favor of discipline. At the time of its final decision, the DNR may revise or modify discipline previously recommended or assessed by the Director of Hockey or the Disciplinary Committee.

 The Disciplinary Committee has the right to suspend any player, parent or coach from attending SDAHC function for violations of SDAHC  By-Laws, rules and regulations, or policy. All coaches, team managers and parents are strongly urged to address problems or complaints as soon as possible.


Guide and SDAHC Policies for Billet Families and Billet Players

SDAHC is often in need of billet parents. The SDAHC has set out a guide to let you know what is expected from you and what you can expect from your billet.

     Guide For All Billet Parents

Out of state players will be housed with billeted families. The player’s coaching staff will work hard at identifying kids with not only hockey talent, but also kids with strong moral and ethical values. For the most part, these players should be good people and you should expect player(s) to be respectful and helpful in your presence and in your home.  But, remember, as a billet parent in California, you are “in loco parentis,” that is, you are, by law, the billet player’s parent on site. 

When a player arrives in your home, it is important that he knows your house rules. Clearly define your expectations and ask the player his expectations of you and your home. The team ahs prepared a 'home guideline' that will be given to every player, it is important that both you and the player sit down to review and discuss the guidelines. Some things that should be discussed with your billet are:

     Billet Guide For Players

The player and his or her family are responsible for all billeting expenses.  Under no circumstances will SDAHC or any of its members be responsible for billeting expenses or for the behavior of billeted players.  We expect a player’s family to pay the Billet Parent $300 per month per player, that is in their home, although this amount is negotiable.  The billet family must make a minimum $600 deposit to the billet parents at the signing of the billet contract.  While part of the billeting expenses can be covered by sponsorship, the deposit must be paid by the billeting player’s family.  The player’s family and billet family should sign a contract specifying terms and conditions for the billeting arrangement.  Be sure to send copies of all insurance cards and other legal documents (passports, driver’s licenses, etc.) with your player. 

Problems?

If a problem arises between you and your billet, contact the player’s coach immediately. If warranted, the Club’s Vice President will be contacted and the problem dealt with immediately.  If problems cannot be worked out, the player will be released and sent home, at the parents expense.
